Joint and several liability means that each debtor is liable for the whole of the debt — you can demand the full amount from whichever of them is able to pay.
In practice
Where there are several debtors and they are jointly and severally liable, you can demand the entire amount from any one of them. You do not have to chase each of them for their own share — you go after the one who has the money.
That debtor can then recover the others’ shares from them afterwards. This is called recourse, and it is their problem, not yours.
Where it commonly goes wrong
- The claim is split up and each debtor pursued for their share. It is neither necessary nor sensible — go after the one who is solvent.
